Sometimes food can make you feel sick.  Usually it’s those leftovers you wolfed down because you were so hungry.  Chances are, if you feel sick after eating them, they were probably old.

The reason old food makes you feel sick is that it has bacteria on it.  Gross, I know, but hang with me for a minute.  Bacteria loves to grow on old food.  Loves it like, I’ll just take a guess, like you love ice cream.  Now imagine, there’s nobody around and there’s a bowl of ice cream in front of you.  I mean, it might as well be a crime to waste a perfectly good bowl of ice cream so obviously the only sensible thing to do is eat it.  That’s exactly how bacteria feel.  They can’t resist the urge to grow on old food, like you couldn’t resist eating the ice cream.  Those bacteria that grew on the old food you ate are what made you feel sick.

Maybe it was a stomach ache, maybe you threw up, maybe you even had diarrhea.  When you have one or more of these things from eating old or bad food, its called food poisoning.  Nobody actually put poison in you food, it was just that bad bacteria grew on it.  Then the bacteria got inside you body form the food you ate and made you feel sick.

Mild cases of food poisoning are common because bacteria is all around us.  People don’t usually go to the hospital for food poisoning because it’s just something that happens sometimes.  The symptoms of food poisoning almost always go away on their own.  Though you probably don’t need to see a doctor for food poisoning, it’s always a good idea to tell an adult when you don’t feel well.

Firstly, I should point out that not all bacteria are bad.  There are plenty of good bacteria in our bodies which we need to survive.  These good bacteria help protect our skin and immune system, as well as work to keep germs and bad bacteria out of our bodies.

Now, I know the good and bad bacteria thing is confusing.  I was confused the first time I heard abot it too, but let me try to explain.  Which kinds of bacteria are to blame for feeling sick?  Well, food that comes from animals, raw foods, and unwashed vegetables can all possibly have germs that cause food poisoning.  The most common source of food poisoning is from meat, poultry (like chicken), eggs, milk, and shellfish.  The most common kinds of bacteria are:

–Salmonella

–Listeria

–E. Coli

–Campylobacter

Unfortunately, yes, most bacteria names are that hard to pronounce.  Scientists really like their big words, but thanks to them we know how to get around those tricky little bad bacteria.

Here are some steps to help you avoid food poisoning:

–Always wash your hands before eating or preparing foods.  Washing your hands gets the bacteria off so that you don’t get them on the food you or others will be eating.

–Check expiration dates on all foods.  Sometimes instead of “expires:” it will say “sell by:” or “best if used by:”.  Don’t eat anything that has expired because it will have bad bacteria all over it!

–Make sure the food you are eating or serving has been properly cooked.  For example if you notice the chicken you are going to eat is raw or still pink inside, don’t eat it just yet.  Show an adult and see if they think it’s okay to eat.

–Smell food before you eat it.  If it smells weird, again, ask an adult before eating it.  (And no please don’t use the excuse of “this smells funny” to get out of eating your vegetables at dinner).

–If you are going to eat leftovers, always heat them up.  The heat kills the bacteria that may have grown on the food while it was in the refrigerator.

–Always cover and refrigerate food right away.  Bacteria has a tougher time growing in cold temperatures so food will stay better longer than if you just left it on the counter.

Lawyers are often asked when an individual can sue the government.  For example, if an individual is injured on public property is the government liable?

That is a hard question to answer because there are various ways the government may or may not be liable for somebody’s injuries.

First, an individual must consider whether the conditions of the area they were injured on are particularly dangerous.  To prove this the plaintiff, the person bringing suit, must show a few things:

1. The property was in dangerous condition at the time of the injury
2. The dangerous condition was the cause of the injury
3. The dangerous condition created a reasonably foreseeable risk of the type of injury the individual sustained
4. The city had actual or constructive notice of the dangerous condition “a sufficient time prior to the injury to have taken measures to protect against the dangerous conditions.

A dangerous condition is defined as “a condition of property that creates a substantial (as distinguished from a minor, trivial or insignificant) risk of injury when such property or adjacent property is used with due care in a manner in which it is reasonably foreseeable that it will be used” Gov. Code 830.  The plaintiff needs to establish at least one specific physical characteristic of the property they were injured on that qualifies as a dangerous condition. A dangerous condition that is not reasonably apparent to someone who is exercising due care is referred to as a “trap”.  A “trap” usually results when “a public entity fails to post signs or warnings of a dangerous condition on the property” such as a sharply banked curve that is not immediately apparent to a driver or a pothole on the road’s surface.

If the plaintiff can prove that physical characteristics of a property made it dangerous even to individuals exercising due care, that is enough to qualify as a dangerous condition.

The government can be liable for these dangerous conditions when it fails “to provide adequate safeguards against a known dangerous condition” such as not posting signs or warnings.  It can not be liable for merely having a dangerous condition on its property or even because it created the condition.  Only if the plaintiff can prove common-law negligence on the part of the employee who created the condition or lack of notice.  A public entity is also responsible to take reasonable precautions to protect children from risks of injury.

However, a public entity can avoid liability for injuries  caused by a dangerous condition if it can establish:

1. A casual relationship between the plan or design and the accident
2. Discretionary approval of the plan or design prior to construction
3. Substantial evidence supporting the reasonableness of the plan or design

A plaintiff can discredit a public entity’s design immunity if they establish three things:

1. The plan or design has become dangerous because of a change in physical conditions
2. The public entity had actual or constructive notice of the dangerous condition thus created
3. The public entity had a reasonable time to obtain funds and carry to the necessary remedial work to bring the property back into conformity with a reasonable design or plan, or the public entity, unable to remedy the condition due to practical impossibility or lack of funds, has not reasonably attempted to provide adequate warning

Wouldn’t it be nice if you could summon a driver to your location, and have them show up in a matter of minutes?  A sort of on-demand personal driver that requires no reservations and no waiting in long lines for taxis.

Well, there’s an app for that.  It’s called Uber.  Uber is a recently released app for iPhones and Androids that allows you to request a driver to your location.  It services 40 different cities in 15 countries.  With Uber and individual can send a text message or use the app to request a driver to a location of the user’s choosing.  User’s receive a picture of the driver that will arrive to pick them up, so they know who to expect.  That user can then track their requested driver’s progress on their way to their location.  Users can add a credit card to their secure account so that instead of having to pay upon arrival to their destination, Uber will simply send them an email with their digital receipt eliminating the need to always have cash on hand.

Drivers for Uber operate such vehicles as Lincoln Town Cars, Cadillac Escalades, Mercedes-Benz S550’s, and BMW 7 Series sedans.  Drivers arrive in nice attire and have a professional air about them.  They are experienced and can get you to your destination quickly and safely.  Many users report feeling extremely safe and comfortable using Uber.  In other words, Uber can give you more value for your money than your average taxi cab.

Recently, Uber just released UberX, a cheaper offshoot of their standard service.  The drivers are more affordable, driving hybrids and mid range type vehicles.  These drivers are unlicensed as taxi drivers but must complete background checks, in-person screening, and other quality control requirements.  Each of these vehicles will be able to seat at least four people in an effort to increase ride sharing.  In the event of ride sharing, users choose “fair split” on the app, and can invite friends to share the ride.  After accepting the invitations Uber will take care of the math and split the bill evenly among all customers involved.

Drunken driving accidents in California have become a serious problem. All too often, this type of accident will result in an innocent victim being seriously injured or killed. In fact, in 2008 over 1,000 people were killed in California in accidents where at least one driver had a blood alcohol level of .08 percent or higher.
