San Diego Car Accidents: Driving in Bad Weather

Though San Diego is not known for bad weather, rain and fog can prove catastrophic, especially for those who do not know what adjustments to make when the weather turns bad. As the weather continues to cool, you should be prepared for every scenario. One mistake can lead to a car accident and result in a serious and debilitating injury.

Wet Road Conditions

Rain creates problems for Southern California drivers. Rain means wet road conditions, which often leads to slick and slippery streets. Inexperience can lead to an accident when wet roads cause a driver to slide off the road or into oncoming traffic. When driving in the rain, you should:

  • Slow down. Make sure you maintain a speed under the posted speed limit.
  • Keep your headlights on.
  • Turn on your air conditioner or defroster to improve visibility.
  • Ensure your tires have proper tread.
  • Ensure your wiper blades are in good condition.

Fog

Though fog is not so common, it does appear from time to time. Fog reduces visibility, making it difficult to avoid other road hazards. When driving in the fog, make sure to:

  • Drive slower than normal.
  • Consider pulling into a parking lot until the fog has lifted.
  • Pull to the side of the road. Make sure your hazard lights are turned on.
  • Avoid using your high beams.
  • Keep a safe distance behind all vehicles ahead of you.

Snowy and Icy Conditions

Wintertime is popular for families to hit the mountains for skiing, snowboarding, and fun in the snow. Though it doesn’t snow in San Diego, popular family winter destinations offer some of the most dangerous road conditions. Here are some safety tips when driving in the snow:

  • Maintain a slow and steady speed.
  • When breaking, do so cautiously. Avoid slamming on your brakes.
  • When approaching a bridge or overpass, keep your speed down and avoid sudden changes in speed.
  • Make sure you have tire chains and that you know how to install them.

When Your Accident Is Not Your Fault

No matter how safe of a driver you are, not all drivers with whom you share the Southern California roadways practice the same safe driving habits. Their negligence can result in you or a loved one suffering a serious car accident injury. That is why you should call experienced car accident attorney Keith J. Stone.

Mr. Stone has helped countless accident injury victims build their cases. He will work hard to defend your compensation rights and ensure you get the best medical treatment possible. He will also work hard to help you get the compensation you and your family deserve.

For many, San Diego is one of the nicest places to live. You can travel on foot nearly year round. Unfortunately, the more people there are on foot, the greater your chances of being involved in a San Diego pedestrian accident. In this article, we discuss simple ways you can avoid a San Diego pedestrian accident.

Who the Pedestrian Is

In short, a pedestrian is any person traveling on foot, riding a skateboard, on rollerskates, or a disabled person required to use a wheelchair for transportation.

Six Ways You Can Help Avoid a Pedestrian Accident

You should always use extra precaution when driving near pedestrians. They are more at risk of being seriously injured than you are. If pedestrians are nearby, you should:

  1. Understand who has the right of way. Pedestrians have the right of way. Always stop for a pedestrian who is crossing the street, whether in a crosswalk or in the middle of the road. Yield to them, even if they are crossing in an area not designated for crossing.
  2. Allow older/disabled people more time to cross. Older and disabled people, especially if confined to wheelchairs, require more time to cross the street. Be patient, and allow them the extra time they require. The same applies for children crossing the street.
  3. Make eye contact. Making eye contact with a pedestrian who appears to be getting ready to cross the street can be the difference between life and death. Never assume that a pedestrian sees you. Make sure they acknowledge you.
  4. Be on the lookout for people walking between parked cars. It’s not always easy to see a pedestrian who is traveling between parked vehicles. You should always be on the lookout for the sudden appearance of pedestrians, especially children.
  5. Avoid passing stopped vehicles at intersections. Never pass a vehicle stopped at an intersection. You may not be able to see a pedestrian that they may have stopped for. Keep in mind that if you can’t see the pedestrian, they probably can’t see you.
  6. Avoid stopping in crosswalks. Stopping in a crosswalk increases the dangers for a pedestrian. Always stop before the painted line.

If You Have Been Injured in a Car Accident

Even the safest drivers in the world can’t always avoid being involved in an accident. You can’t control the driving habits of others, and their negligence can lead to you suffering a serious injury. That is why you should call Keith J. Stone.

Mr. Stone is experienced in handling all types of car accident and pedestrian accident cases. He will do everything he can to make sure you get the medical attention you deserve and that the responsible party is held liable for your damages.

Many motorists are still not convinced of the benefits of seat belts. There are many reasons for this. However, most studies and crash test results conclude that you have a better chance of surviving a crash and less likely to be seriously injured in a San Diego car accident if you are buckled up.

Four Common Seat Belts Myths

Many seat belt myths keep drivers and passengers from buckling up. Four of the most popular myths include:

  1. You might be left trapped in your car during a car fire or accident involving water. Very rarely do seat belts become stuck and fail. As a matter of fact, it takes less than a second to take off a seat belt, and a seat belt will drastically reduce your chances of being knocked out in an accident.
  2. Many victims are thrown from a vehicle and walk away with only a scratch. This myth couldn’t be further from the truth. You are five times more likely to survive a crash if you are properly restrained and not thrown from your vehicle during a collision with another vehicle.
  3. There is nothing wrong with not wearing a seat belt when traveling around town. Statistics conclude that you are more than half as likely to lose your life in a car accident within 25 miles of your home. No matter where you are going, you should always ensure that you and your passengers are buckled up.
  4. Small children do not need to be in a safety seat when going down the street. It makes no difference where you are going. State law requires all young children, even if going down the street to the store, to be properly secured in a child safety seat. The DMV California Driver Handbook states that “car accidents are the number-one preventable cause of death for children.”

Statistics suggest that traveling at a high speed is one of the most dangerous things you can do when behind the wheel and can result in a serious San Diego car accident.  No matter where you are driving, you should always be aware of how fast you are driving.

When to Slow Down

There are many situations in which you should exercise extreme caution and reduce your speed. Here are four of the most common:

  • In bad weather. Besides producing wet and slippery road conditions, bad weather can reduce your visibility. Driving slower than normal will help you respond and avoid sudden road dangers.
  • Heavy traffic. Southern California is known for its heavy traffic. It’s much more difficult to navigate your vehicle when the freeways and roads are congested. Again, you should drive slower than normal. Avoid the “Number 1 Lane” if you choose to drive slower than other traffic.
  • Near children and schools. No matter where you are at, if there are children about, you should always reduce your speed, especially near schools. The speed limit is 25 mph within 500 to 1,000 feet of a school, unless otherwise posted. When near a school, be on the lookout for other pedestrians, bicyclists, crossing guards and stopped school buses.
  • Buses, trucks, and towing vehicles. You should never assume drivers of large vehicles can see you. Their blind spots are much larger than the average vehicle. You could easily lose control of your vehicle in the event a bus, large truck, or tow vehicle makes a sudden lane change.

When Another Driver is Responsible for Your Injuries

Unfortunately, no matter how safe of a driver you are, the negligence of another driver can result in you or a loved one suffering a serious injury. Keith J. Stone is experienced in handling all types of motorized vehicle accidents and can help you hold the responsible party liable for your injuries.

A collision with a commercial truck can significantly alter the quality of your life. Big-rigs are much bigger and heavier than cars, and an accident with a tractor-trailer could leave you permanently injured, unable to earn a living, and facing a mountain of unpaid medical bills.

What You Can Do to Avoid a Truck Accident

Though not all truck accidents can be avoided, there are certain things you can do as a driver that can reduce your chances of being involved in one. Here are five:

  1. Regularly maintain your vehicle. It’s not your responsibility to make sure trucks are properly maintained. However, regular vehicle maintenance on your own vehicle can minimize your risk of being in a collision with a tractor-trailer. Make sure your brakes are in good condition, your tires are properly inflated, and that your headlights, brake lights, and turn signals are working at all times.
  2. Use caution around a truck’s blind spots. Assuming that a truck driver can see you might end with fatal consequences. Keep in mind that a truck’s blind spots are bigger, making it more difficult for a trucker to see you than for you to see them. Avoid lingering alongside a truck and avoid passing a truck on the right.
  3. Avoid tailgating. The last thing you want is to be following too close to a semi when the trucker has to slow down or stop suddenly. The size of the truck will make it difficult for you to see any road hazards the trucker may encounter. Maintain a proper distance when behind any big-rig.
  4. Be extra careful when using entrance ramps. A commercial truck cannot slow down or stop as quickly as other types of vehicles. When getting on a freeway or entering a roadway, make sure you allow any approaching semis plenty of space. This will reduce your chances of being run off the road.
  5. Use extra caution when driving in bad weather and/or at night. Bad weather reduces visibility and can produce unsafe roads conditions, especially at night. Make sure you slow down and have your headlights on. This will help truckers identify your vehicle.

California is home to a disproportionately large sector of the pedestrian public, and as a result, pedestrian accidents in San Diego and other cities in the Golden State are common. If you or someone you love has been gravely injured in a pedestrian accident, an attorney at a San Diego injury law firm may be able to help you receive the compensation you need.

Unfortunately, they cannot minimize the damage caused by the guilty party, but a San Diego pedestrian accident attorney can get you the monies needed to provide for your medical needs and living expenses through an accident claim.

Pedestrian Accidents in San Diego and the U.S.

Every year, out of the 75,000 pedestrians who are injured or killed in pedestrian accidents, a startling proportion of those occur in San Diego and the greater California region. The National Highway Transportation Safety Administration (NHTSA) estimates that of the approximate 75,000 pedestrian accidents, about 4,654 result in death. In many cases, the negligence of the driver causes a fatal pedestrian accident.

The NHTSA also reported that in 2008, California was the home of 620 of the national total of fatal pedestrian accidents – approximately 14%. As metro areas grow in size and the number of pedestrians in these areas, such as San Diego, increases, the risk of a pedestrian accident becomes more severe.

Pedestrian accidents often result in more serious injuries
than car-on-car accidents because pedestrians lack protection from a vehicle. Unfortunately, those who are at the highest risk for pedestrian accidents – children and the elderly – are also the most physically vulnerable to the ramifications, and are the most likely to suffer substantial injuries.

In many cases, a pedestrian accident in San Diego is caused by negligence
on the part of the driver, such as:

Drivers are trained to look for cars on the road, and when their concentration is split by navigating and various other driver responsibilities (or distractions), they can overlook the importance of looking around for pedestrians.

If you or someone you love has been injured in one of the pedestrian accidents of San Diego, an attorney from a San Diego injury law firm can help.

Sometimes food can make you feel sick.  Usually it’s those leftovers you wolfed down because you were so hungry.  Chances are, if you feel sick after eating them, they were probably old.

The reason old food makes you feel sick is that it has bacteria on it.  Gross, I know, but hang with me for a minute.  Bacteria loves to grow on old food.  Loves it like, I’ll just take a guess, like you love ice cream.  Now imagine, there’s nobody around and there’s a bowl of ice cream in front of you.  I mean, it might as well be a crime to waste a perfectly good bowl of ice cream so obviously the only sensible thing to do is eat it.  That’s exactly how bacteria feel.  They can’t resist the urge to grow on old food, like you couldn’t resist eating the ice cream.  Those bacteria that grew on the old food you ate are what made you feel sick.

Maybe it was a stomach ache, maybe you threw up, maybe you even had diarrhea.  When you have one or more of these things from eating old or bad food, its called food poisoning.  Nobody actually put poison in you food, it was just that bad bacteria grew on it.  Then the bacteria got inside you body form the food you ate and made you feel sick.

How to avoid food poisoning you may ask? Lets find out.

Mild cases of food poisoning are common because bacteria is all around us.  People don’t usually go to the hospital for food poisoning because it’s just something that happens sometimes.  The symptoms of food poisoning almost always go away on their own.  Though you probably don’t need to see a doctor for food poisoning, it’s always a good idea to tell an adult when you don’t feel well.

Firstly, I should point out that not all bacteria are bad.  There are plenty of good bacteria in our bodies which we need to survive.  These good bacteria help protect our skin and immune system, as well as work to keep germs and bad bacteria out of our bodies.

Now, I know the good and bad bacteria thing is confusing.  I was confused the first time I heard abot it too, but let me try to explain.  Which kinds of bacteria are to blame for feeling sick?  Well, food that comes from animals, raw foods, and unwashed vegetables can all possibly have germs that cause food poisoning.  The most common source of food poisoning is from meat, poultry (like chicken), eggs, milk, and shellfish.  The most common kinds of bacteria are:

–Salmonella

–Listeria

–E. Coli

–Campylobacter

Unfortunately, yes, most bacteria names are that hard to pronounce.  Scientists really like their big words, but thanks to them we know how to get around those tricky little bad bacteria.

Here are some steps to help you avoid food poisoning:

–Always wash your hands before eating or preparing foods.  Washing your hands gets the bacteria off so that you don’t get them on the food you or others will be eating.

–Check expiration dates on all foods.  Sometimes instead of “expires:” it will say “sell by:” or “best if used by:”.  Don’t eat anything that has expired because it will have bad bacteria all over it!

–Make sure the food you are eating or serving has been properly cooked.  For example if you notice the chicken you are going to eat is raw or still pink inside, don’t eat it just yet.  Show an adult and see if they think it’s okay to eat.

–Smell food before you eat it.  If it smells weird, again, ask an adult before eating it.  (And no please don’t use the excuse of “this smells funny” to get out of eating your vegetables at dinner).

–If you are going to eat leftovers, always heat them up.  The heat kills the bacteria that may have grown on the food while it was in the refrigerator.

–Always cover and refrigerate food right away.  Bacteria has a tougher time growing in cold temperatures so food will stay better longer than if you just left it on the counter.

Lawyers are often asked when an individual can sue the government.  For example, if an individual is injured on public property is the government liable?

That is a hard question to answer because there are various ways the government may or may not be liable for somebody’s injuries.

First, an individual must consider whether the conditions of the area they were injured on are particularly dangerous.  To prove this the plaintiff, the person bringing suit, must show a few things:

  1. The property was in dangerous condition at the time of the injury
  2. The dangerous condition was the cause of the injury
  3. The dangerous condition created a reasonably foreseeable risk of the type of injury the individual sustained
  4. The city had actual or constructive notice of the dangerous condition “a sufficient time prior to the injury to have taken measures to protect against the dangerous conditions.

A dangerous condition is defined as “a condition of property that creates a substantial (as distinguished from a minor, trivial or insignificant) risk of injury when such property or adjacent property is used with due care in a manner in which it is reasonably foreseeable that it will be used” Gov. Code 830.  The plaintiff needs to establish at least one specific physical characteristic of the property they were injured on that qualifies as a dangerous condition. A dangerous condition that is not reasonably apparent to someone who is exercising due care is referred to as a “trap”.  A “trap” usually results when “a public entity fails to post signs or warnings of a dangerous condition on the property” such as a sharply banked curve that is not immediately apparent to a driver or a pothole on the road’s surface.

If the plaintiff can prove that physical characteristics of a property made it dangerous even to individuals exercising due care, that is enough to qualify as a dangerous condition.

The government can be liable for these dangerous conditions when it fails “to provide adequate safeguards against a known dangerous condition” such as not posting signs or warnings.  It can not be liable for merely having a dangerous condition on its property or even because it created the condition.  Only if the plaintiff can prove common-law negligence on the part of the employee who created the condition or lack of notice.  A public entity is also responsible to take reasonable precautions to protect children from risks of injury.

However, a public entity can avoid liability for injuries  caused by a dangerous condition if it can establish:

  1. A casual relationship between the plan or design and the accident
  2. Discretionary approval of the plan or design prior to construction
  3. Substantial evidence supporting the reasonableness of the plan or design

A plaintiff can discredit a public entity’s design immunity if they establish three things:

  1. The plan or design has become dangerous because of a change in physical conditions
  2. The public entity had actual or constructive notice of the dangerous condition thus created
  3. The public entity had a reasonable time to obtain funds and carry to the necessary remedial work to bring the property back into conformity with a reasonable design or plan, or the public entity, unable to remedy the condition due to practical impossibility or lack of funds, has not reasonably attempted to provide adequate warning

Cases involving suing the government are very complex.  The government has at their disposal many specific immunities and claim requirements.  Do not attempt to do this battle alone!

Pedestrian Accidents in San Diego: Common and Dangerous

Crossing streets and walking a few blocks are daily routines for most city residents and visitors. However, the National Highway Transportation Safety Administration estimates that on average, a fatal pedestrian accident occurs about once every 2 hours, and a pedestrian accident resulting in injury occurs once every 8 minutes. This leaves thousands of people injured or killed every year due to pedestrian accidents.

More troubling, however, is that the NHTSA also reported that in 2008, 620 of the 4,414 pedestrian accidents that resulted in death occurred in the state of California. That is about 14% of the national total. These accidents are more likely to occur in California than in other states.

Children and Senior Citizens at Risk for Pedestrian Accidents

Most at risk for pedestrian accidents in San Diego are children and the elderly, who are not only more likely to use pedestrian access sidewalks, but are also more physically vulnerable to the consequences of even a mild collision.

In fact, thousands of senior citizens are injured in pedestrian accidents each year and hundreds of them end up fatal. Additionally, children aged 14 and under comprise almost half of the pedestrian accident victims injured, and of those accidents, nearly 10% end up being fatal.

Recovering Damages after a Pedestrian Accident

As with any car accident, an injured victim may be able to recover damages for his or her injuries through a personal injury claim if it can be shown that the other party in the accident was at fault.

The often extensive medical treatment required to recover from the injuries sustained in a pedestrian accident comes at a high cost, and if the accident that caused your injuries was not your fault, you should not be held liable for shouldering the financial cost of your rehabilitation.

Pedestrian accidents in San Diego can result in loss of life, limb, and loved ones. If you or someone you care about has been hurt in an accident, contact a San Diego injury law firm and speak with an attorney who will aggressively pursue your injury claim while treating you with the compassion you need in your time of crisis.

Wouldn’t it be nice if you could summon a driver to your location, and have them show up in a matter of minutes?  A sort of on-demand personal driver that requires no reservations and no waiting in long lines for taxis.

Well, there’s an app for that.  It’s called Uber.  Uber is a recently released app for iPhones and Androids that allows you to request a driver to your location.  It services 40 different cities in 15 countries.  With Uber and individual can send a text message or use the app to request a driver to a location of the user’s choosing.  User’s receive a picture of the driver that will arrive to pick them up, so they know who to expect.  That user can then track their requested driver’s progress on their way to their location.  Users can add a credit card to their secure account so that instead of having to pay upon arrival to their destination, Uber will simply send them an email with their digital receipt eliminating the need to always have cash on hand.

Drivers for Uber operate such vehicles as Lincoln Town Cars, Cadillac Escalades, Mercedes-Benz S550’s, and BMW 7 Series sedans.  Drivers arrive in nice attire and have a professional air about them.  They are experienced and can get you to your destination quickly and safely.  Many users report feeling extremely safe and comfortable using Uber.  In other words, Uber can give you more value for your money than your average taxi cab.

Recently, Uber just released UberX, a cheaper offshoot of their standard service.  The drivers are more affordable, driving hybrids and mid range type vehicles.  These drivers are unlicensed as taxi drivers but must complete background checks, in-person screening, and other quality control requirements.  Each of these vehicles will be able to seat at least four people in an effort to increase ride sharing.  In the event of ride sharing, users choose “fair split” on the app, and can invite friends to share the ride.  After accepting the invitations Uber will take care of the math and split the bill evenly among all customers involved.

Uber is a great way to get a ride wherever you need fast.  Spending a few dollars on Uber is surely far more appealing than dealing with the costs and consequences of a DUI.  Driving under the influence is extremely dangerous not only to those driving, but to anyone else around.  Drunk drivers have a substantially higher chance of getting in a collision which could result in severe bodily harm or death.  If you ar drunk or under the influence of any kind, spending a few dollars is definitely a preferable alternative to any of the consequences of a DUI.  It’s easy to use and their personalized service gives you more value for your money than a standard taxi cab.
